The Climate-Friendly & Equitable Communities (CFEC) rules were created by the State of Oregon based on an executive order issued by former Governor Kate Brown.

The new rules require some cities and counties to make significant changes to their regulations around land use and development, parking requirements, transportation system planning, and expanded regional coordination.

These new rules have several areas of focus:

Parking Management Reform
Climate Friendly Areas (Regional and Town Center)
Preparing for Electric Vehicles
Planning for Future Transportation
Regional Planning for Climate Goals

Each of these areas require cities to change their existing rules and policies, and the City must implement the CFEC required rules and regulations within specific timeframes.

Some of the changes, including the elimination of parking minimums near frequent transit service and requiring EV ready parking in new developments, have already been implemented.

Now, the City of Hillsboro must implement changes in its approach to parking by January 2, 2025.

And, in the coming years, the City will be updating its Transportation System Plan to align with the requirements of the Climate Friendly and Equitable Communities rules.

January 2023: Phase One Parking Reforms

Reduction of Parking Based on Development Type
Parking Reform Transit Corridors

April 2023: Electric Vehicle Charging

Require new multi-dwelling/mixed-use developments (with more than 5 units) to have 40% of all provided parking spaces EV ready.

January 2025: Phase Two Parking Reforms

Communities with 50,000+ population must implement parking management citywide.

2026-2029: Transportation System Updates

The City of Hillsboro will plan to bring its Transportation System Plan into compliance with Climate-Friendly and Equitable Communities rules.

Requirements

Required Policy Changes

Preferential parking for carpools/vanpools
Allow redevelopment of parking for bicycle/transit facilities

Allow/encourage redevelopment of existing parking Allow/facilitate shared parking

Require new developments that include more than 1/2 acre of surface parking to either provide:
- Solar panels or fee in lieu
- 40% tree canopy coverage

Require at least 30% tree canopy over parking areas and pedestrian facilities connecting building entrances, existing/planned pedestrian facilities, transit stops, and accessible parking spaces

Implement parking maximums in downtowns, designated regional/community centers, developments near transit

Adopt specific parking maximums in designated regional/community centers and within 1/4 mile of frequent transit corridors and 3/4 mile of rail transit stops.

Parking Reform

Phase One: Parking Reform

As required by the State of Oregon the first phase of parking regulations went into effect January 2023.

Reduction of Parking Based on Development Type

New Rule: The city can not require off-street parking for certain types of development, such as:

affordable housing
dwellings under 750 sq. ft.
childcare facilities
facilities for people with disabilities
shelters

Parking Reform Near Significant Transit Corridors

New Rule: No off-street parking can be required for new developments within 3/4 mile of a rail station or 1/2 mile walking distance of frequent transit corridors.

The map below shows the areas (in yellow) where the City is not allowed to require off-street parking for new developments.

Phase Two: Parking Reform

In addition to not requiring off-street parking for new development near transit corridors as required by Phase One, the City of Hillsboro must now shift how parking is managed citywide in order to address the new State of Oregon mandates.

Citywide Repeal of All Off-Street Parking Minimums

No off-street parking will be required for any developments within the City of Hillsboro. Instead, developers would determine, and provide, the amount of parking they think is appropriate for their project.

Draft Code Amendments are now available for review.

Parking Reform Phase Two Key Dates:

November 19 - City Council First Reading
December 3 - City Council Second Reading
January 2 - Effective Date
